1. Our approach
BigHub Market respects the rights of creators. Businesses and users must only upload photos, videos, text and other material they own or are licensed to use.
Copyright owners, or people authorised to act for them, can tell us about material on BigHub Market that they believe infringes their work. We review every complaint and may restrict or remove content where appropriate.
This policy describes our procedure. It is not legal advice, and filing or responding to a complaint may have legal consequences. Consider speaking to a lawyer.
2. How to report
Use the online form at /report-copyright (you need a free account so we can update you on the case). You may also write to support@bighubmarket.com.
A complete complaint includes: your name, email and postal address; a description of the original work; the exact BigHub Market links to the material you object to; an explanation of the infringement; a statement that you believe in good faith the use is not authorised by the owner, its agent or the law; a statement that the information is accurate and that you are the owner or authorised to act for the owner; and your electronic signature.
Incomplete complaints may be paused while we ask for missing information.
3. United States — DMCA procedure (17 U.S.C. § 512)
Where U.S. law applies, a notice should contain the elements listed in 17 U.S.C. § 512(c)(3). Under § 512(f), anyone who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages.
After restricting material we notify the affected user. They may send a counter-notice (§ 512(g)) stating under penalty of perjury that the material was removed by mistake or misidentification and consenting to the jurisdiction of the appropriate U.S. Federal District Court (or, if outside the U.S., any judicial district where BigHub Market may be found) and to accept service from the complainant.
We forward a valid counter-notice to the complainant. Unless the complainant tells us they have filed a court action seeking to restrain the user, the material may be restored no sooner than 10 and no later than 14 business days after we receive the counter-notice.
BigHub Market has not yet confirmed registration of a designated DMCA agent with the U.S. Copyright Office. Until that is done, nothing on this page should be read as a claim of DMCA registration or safe-harbour protection.
4. Nigeria — Copyright Act 2022 procedure
Where Nigerian law applies, complaints are handled under the Copyright Act 2022, which includes a takedown-notice procedure for online service providers and is administered by the Nigerian Copyright Commission (NCC).
We ask Nigerian complainants for the same information as above. The affected user is notified and may respond with a counter-notice explaining why the content does not infringe. Statutory steps and time limits in the Act, and any regulations or guidance issued by the NCC, take precedence over this page.
Copyright owners may also pursue remedies directly through the NCC or the Federal High Court. BigHub Market cannot decide ownership disputes on behalf of a court.
The U.S. DMCA counter-notice timeline (10–14 business days) is a U.S. rule and is not automatically applied to Nigerian cases.
5. Other countries
BigHub Market is global. If another country's law applies, tell us in your complaint. We review it against this policy and applicable local law.
6. What we do after a complaint
Our team reviews the complaint, may ask either party for more information, and records each step and decision in an internal case history.
If a complaint is upheld, the listing or business page may be hidden or the content removed, and the affected user is notified with the reason. If it is not upheld, the complainant is told why.
7. Repeat infringers
Each upheld complaint adds a strike to the responsible account. Strikes withdrawn after a successful counter-notice or a mistaken decision are cleared.
First strike: warning and content restricted. Second strike within 12 months: additional review of the account's listings and possible temporary limits on posting or listing. Third strike within 12 months: the account is referred for termination review, and accounts of repeat infringers may be terminated in appropriate circumstances.
